Terms of Service

1. Acceptance of Terms

By accessing or using BookSafaari, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Account Registration

To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised use of your account.

3. Bookings and Payments

BookSafaari facilitates accommodation bookings between guests and hosts. When you confirm a booking:

• You agree to pay the total amount displayed, including any service fees and applicable taxes.
• Payment is processed securely through our third-party payment providers.
• Hosts receive payouts according to the payout schedule outlined in their host agreement.
• BookSafaari acts as an intermediary and is not a party to the rental agreement between guest and host.

4. Cancellation and Refunds

Cancellation policies are set by individual hosts and displayed on each listing. Common policies include:

• Flexible: Full refund if cancelled at least 24 hours before check-in.
• Moderate: Full refund if cancelled at least 5 days before check-in.
• Strict: 50% refund if cancelled at least 7 days before check-in; no refund after that.

BookSafaari may issue refunds at its discretion in cases of extenuating circumstances such as natural disasters, safety emergencies, or significant listing misrepresentation.

5. Host Obligations

• Provide accurate and up-to-date listing information, including descriptions, photos, pricing, and availability.
• Maintain the property in a clean, safe, and habitable condition.
• Comply with all applicable local laws, regulations, and tax obligations related to short-term rentals.
• Respond to booking requests and guest inquiries in a timely manner.
• Honour confirmed bookings and not cancel without valid reason.

6. Guest Obligations

• Treat the host's property with respect and leave it in a reasonable condition.
• Adhere to house rules set by the host.
• Communicate honestly and promptly with hosts regarding your stay.
• Not exceed the agreed number of guests without prior host approval.
• Report any property damage or issues during your stay.

7. Prohibited Activities

You agree not to:

• Use the platform for any unlawful purpose.
• Post false, misleading, or fraudulent listings or reviews.
• Attempt to circumvent the BookSafaari payment system or service fees.
• Harass, threaten, or discriminate against other users.
• Scrape, crawl, or use automated means to access the platform without permission.
• Upload malicious code or interfere with the platform's operation.

8. Limitation of Liability

BookSafaari provides a platform for connecting guests and hosts. We do not own, manage, or control any listed properties. To the maximum extent permitted by law, BookSafaari shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to property damage, personal injury, or loss of data. Our total liability shall not exceed the amount of fees you have paid to BookSafaari in the twelve months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Uganda.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the platform or by email. Your continued use of BookSafaari after such changes constitutes acceptance of the updated Terms.
